Required documents

Required documents for state registration of ownership rights on apartments based on the notarized contract and certificates of inheritance:

• Application;
• Applicant’s identification document;
• Notarized power of attorney, if application is submitted by other person on behalf of right holder (legal person’s application and representative’s power of attorney should be confirmed by legal person’s seal);
• Sale, donation, exchange, rental agreement, inheritance certification, wedlock registration and etc.;
• Distribution scheme drawn up by the relevant local authorities of State Register Service of Real Estate, if real estate is partially alienated;
• Document confirming the payment of the state fee.

Required documents for state registration of ownership rights on apartments if private houses were obtained through auction that already have extract registered by state registration of real estate:

• Application;
• Applicant’s identification document;
• Notarized power of attorney, if application is submitted by other person on behalf of right holder (legal person’s application and representative’s power of attorney should be confirmed by legal person’s seal);
• Final protocol on open auction held by the specialized agencies prescribed by law; 
• Certificate for obtaining apartments through public auction excluding the case of sale of mortgaged property in auction;  
• A document on payment of the state fee. 

Required documents for issuance of duplicate of lost, damaged, or completely destroyed documents confirming the ownership rights on apartments that already have extract and registered by state registration of real estate:

• Application
• Applicant’s identification document;
• Notarized power of attorney, if application is submitted by other person on behalf of right holder (legal person’s application and representative’s power of attorney should be confirmed by legal person’s seal);
• Announcement published in media; 
• Certificate from Findings Bureau of Police Department;
• Original copy confirming the uselessness of document of  ownership rights
• A document on payment of the state fee.

• Issuance of technical passports to apartments:

  Technical passports are issued based on the following documents:

  - application (appeal);

  - applicant’s ID;

  - document confirming the ownership right;

  - technical documents for technical specifications of real estate (if exists);

  - document confirming the payment of state fee.

State registration of rights on apartments is conducted based on the application submitted by authorized person by him/her or sent via notary. Individual’s last name, name, patronymic name, address, identification document, legal person’s name, address, certification on registration, name and address of the executive authority, content of the petition and attached documents should be mentioned in the application.

30 AZN (If issued for 20 days, 20 AZN service fee (s/f); If issued for 14 days, 30 AZN s/f in Baku, Ganja, Sumgait cities and Absheron region; if issued for 7 days, 40 AZN s/f; if issued for 14 days in other cities or districts, 26 AZN s/f; if issued for 7 days, 30 AZN s/f.)

Registration of real estate obtained based on the certificates on inheritance right

20 AZN (If issued for 20 days, 20 AZN service fee (s/f); If issued for 14 days, 30 AZN s/f in Baku, Ganja, Sumgait cities and Absheron region; if issued for 7 days, 40 AZN s/f; if issued for 14 days in other cities or districts, 26 AZN s/f; if issued for 7 days, 30 AZN s/f.)

Issuance of duplicate of extract about state registration of ownership rights on real estate.

10 AZN (20 AZN s/f)

 Exemptions from state fee for issuance of documents related with state registration of ownership rights and other proprietary rights to real estate.

State fee is not charged from citizens, enterprises and organizations who donated his/her property to the state.

State fee is not charged for issuance of ownership certificate related with the passage of municipal property to state real estate.

State fee is not accepted from person affected by the acquisition if the state fee for state registration of rights on the result of acquisition is not added to the amount of compensation paid according to the “Land acquisition for state needs” on the basis of the Law of the Republic of Azerbaijan.

Issuance of technical passports to apartments:

- for issuance of technical documents (passport and plan size) for apartments – 50 AZN

- issuance of duplicate of technical documents (passport and plan size)  for apartments – 10 AZN
