Approval of the lease agreement

Required documents

  1. A document confirming ownership of the property;
  2. If the owner is married, his/her marriage certificate;
  3. The husband's (wife's) notarized consent to lease real estate;
  4. Certificate from the state registry on the description of real estate, a state registered rights, and their limitation (encumbrance).

Required persons

1. The lessor or his/her representative based on the power of attorney approved by the notary;

2. The lessee or his representative based on the power of attorney approved by the notary public

State Fee

1. If the parties consist of a husband (wife), children, parents, grandparents, grandchildren, brothers, or sisters - the state fee is 15 manats, and the fee charged for the service is 2.25 manats;

2. If one of the parties is a natural or legal person engaged in the production of agricultural products - the state fee is 15 manats, and the fee charged for the service - 2.25 manats;

3. If the parties are other natural or legal persons - the state fee is 100 manats, and the service fee is 15 manats.

Note

  • According to the Law of the Republic of Azerbaijan "On Compulsory Insurance", insurance of real estate owned by legal entities and individuals is mandatory.

The original documents on the basis of which the notarial act was performed are attached to the copy of the contract, certificate of inheritance rights, etc. kept in the notary. Original documents (for example, birth, marriage, and death certificates) are returned to the persons who presented them, and their notarized copies are kept at the notary.
