A document confirming ownership of the property;
Certificate issued by the State Registry Service of Real Estate under the State Committee for Real Estate Issues on whether there is an encumbrance or arrest on the property;
If the owner is married, his/her marriage certificate;
Notarized consent of the husband (wife) to the donation of real estate;
Notarized consent of all registered adult family members about their residence registration in a residential house, apartment, garden, and summer house;
Documents confirming the kinship between the parties (documents issued by the state registration body of acts of civil status) or a legally binding court resolution on the determination of kinship.
Tenant or his/her representative on the basis of a power of attorney approved by the notary public;
The rent payer or his/her representative on the basis of a power of attorney approved by the notary public.
If the property is transferred to a husband (wife), children, parents, grandfather, grandmother, grandchild, brother, or sister according to the contract - the state fee shall be 25 manats, and the service fee shall be 3.75 manats
If the property is transferred to other persons under the contract:
In the city of Baku - the state fee shall be 280 manats, the service fee shall be 42 manats.
In the cities of Sumgait, Ganja, and Absheron region, the state fee shall be 196 manats, the service charge is 29.40 manats.
in other cities and districts - the state fee shall be 140 manats, the service fee shall be 21 manats.
The original documents on the basis of which the notarial act was performed are attached to the copy of the agreement, the certificate of inheritance rights etc. kept in the notary. Original documents (for example, birth, marriage, and death certificates) are returned to the persons who presented them, and their notarized copies are kept at the notary.
