Mobile monitorings by Labor Relations Monitoring Center have been continuing
The mobile monitorings at construction companies relating to “Regulation of unofficial labor relations in construction" conducted by the Center for Monitoring of Labor Relations of the State Agency for Public Service and Social Innovations established under the Decree of the President of the Republic of Azerbaijan No 1349 of April 28, 2017 have been continuing.
Information accepted regarding the construction companies by the state bodies are analyzed and in the case of necessity Mobile monitoring groups of the center implements mobile monitoring to the construction objects. During 1 year of operation, 58 mobile monitorings have been conducted by the Labor Relations Monitoring Center. Mobile Monitoring has covered 105 juridical and physical persons engaged in the construction of multifunctional residential buildings in Baku.
During the inspection period, it has been observed that 723 persons have been working contactless (without the service or property contract).
In order to take appropriate measures, facts revealed as a result of monitoring, the information about 27 legal and physical persons was directed to the Ministry of Labor and Social Protection of Population and 24 legal and physical persons, respectively, was directed to the Prosecutor General's Office of the Republic of Azerbaijan.
The involvement of a number of employees (ten and more persons) in the any work (services) without the labor contract in the order envisaged by the Labor Code, will be punished by a fine of seven thousand to ten thousand manats or imprisonment for the term up to two years is expected.
The Labor Monitoring Center warns, considering that mobile monitoring is continuing, labor contracts should be electronically documented, and labor contracting systems should not be involved in the construction site until the contract is in force.
Should note that, the purpose of the monitoring is to protect the labor rights of the citizens in the field of construction, ensure the enjoyment of social security and strengthen the control over the labor relations.
Mobile monitorings have been continuing and the results will be publicly disclosed.
